Immigrant lawyers Salvadoran asked that he returned to Maryland to prevent his rapid expulsion from Tennessee.
Federal prosecutors told a Maryland judge that the United States government planned to initiate a new series of procedures Kilmar Abrego GarciaA salvadoinan man whose erroneous expulsion in March attracted outcry.
Thursday, lawyer for the Ministry of Justice, Jonathan Guynn, said that the procedure for dismissal would be a “third country”, not to El Salvador, where Abrego Garcia was previously expelled.
But the prosecutor also said that government plans are not “imminent”. Guynn added that the United States government would respect all orders in the court.
The government plan was revealed as part of an emergency request to the US District Judge Paula Xinis in Greenbelt, Maryland.
Abrego Garcia is currently detained in Tennessee, where he faces criminal charges. But the judges of Tennessee indicated that they planned to release Abrego Garcia – leaving him vulnerable to the arrest by immigration agents.
His lawyers asked the judge Xinis to order the government to take Abrego Garcia to Maryland when he was released in Tennessee, to prevent his expulsion before he was tried.
“We fear that the government can try to quickly withdraw Mr. Abrego Garcia over the weekend,” said Jonathan Cooper, one of the lawyers for Abrego Garcia.
Justice Xinis, however, said that she couldn’t move as quickly as Abrego Garcia’s lawyers asked for him.
Abrego Garcia is one of the most eminent immigrants swept away in the recent push of President Donald Trump for “mass deportation”.
Although he was submitted to a 2019 protection order allowing him to stay in the country, Abrego Garcia was arrested and expelled around March 15, triggering a high -level legal battle for his return.
Initially, he was detained with hundreds of other men expelled at Centro de Confinamiento del Terrorismo in El Salvador, or Cecot, a maximum security prison accused of abusive housing. But in April, in the midst of a meticulous media exam, it was revealed that he had been transferred to another installation of the city of Santa Ana.
Before his dismissal, Abrego Garcia had not been accused of a crime. But when the United States government announced his sudden return on June 6, he revealed that he had asked for an indictment against Abrego Garcia for human smuggling.
This case is underway in Tennessee. Abrego Garcia pleaded not guilty and his lawyers argued that accusations are an attempt by the Trump administration to save face.
The Trump administration, on the other hand, accused Abrego Garcia of being a member of the Gang MS-13 and a danger to society. He relied on a video in 2022 of a traffic stop involving Abrego Garcia as proof: he is seen driving a large vehicle with nine passengers, while a police officer speculates why they have no luggage.
The officials previously described the initial expulsion of Mars of Abrego Garcia as an “administrative error”.
Separately from the Tennessee case, judge Xinis assessed whether the expulsion on the move was illegal – and if the actions of the Trump administration constitute an outrage in the court.
In April, Xinis, and later the Supreme Court of the United States, judged that the United States government had the obligation to “facilitate” the return of Abrego Garcia d’El Salvador after his erroneous deportation.
But ABREGO GARCIA’s lawyers argued that the US government had delayed and did not provide legal information on its return. During all this time, they say, the Trump administration was preparing criminal charges against their client.
On Thursday, judge Xinis said that she was to examine the Trump administration requests to reject the case before she could rule on the emergency request to bring Abrego Garcia to Maryland.
She planned a legal hearing of July 7 in Maryland to discuss the emergency request and other questions.
Abrego Garcia is currently in police custody in Tennessee to prevent a second expulsion.
