Critics argue that President Trump exceeded his constitutional authority by reducing the assistance approved by the congress.
A Court of Appeal of the United States judged that President Donald Trump can continue efforts to reduce foreign help payments, despite these funds designated by the congress.
The decision of two to a Wednesday canceled a previous injunction which forced the Ministry of State to resume payments, including approximately $ 4 billion for the American Agency for International Development (USAID) and $ 6 billion for HIV and AIDS programs.
But the majority opinion of the Court of Appeal did not weigh the merits of whether Trump could nix congress the funds.

“The acquiescence and facilitation of the Court in the illegal behavior of the executive derails the carefully designed system of verified and balanced power which serves as greater security against tyranny – the accumulation of excessive authority in a single branch,” wrote Pan in his opinion.
The leader gives a victory to the Trump administration, which faced a series of legal challenges Trump’s efforts to radically reshape the federal government.
This includes dramatic cuts for spending and government agencies like USAID, which was created by an act of congress.
