Baharav-Miara in Loggerheads with Prime Minister Netanyahu on corruption accusations, his “judicial coup” and the dismissal of Shin Bet chief.
The High Court of Israel made a temporary order freezing an attempt by the government to dismiss the prosecutor General Gali Baharav-Miara, in the last case of the closing ranks of the far-right coalition.
The decision of the Monday court came immediately after the Israeli cabinet voted unanimously to draw Baarav-miaraThe highest legal leader in the country, who led the pursuit of Israeli Prime Minister Benjamin Netanyahu corruption.
The Minister of Justice, Yariv Levin, announced the cabinet’s decision and sent a letter to Baharav-Miara saying that she “should not try to impose herself on a government that does not trust her and cannot work with her”.
However, immediately after the decision, the opposition party Yesh Atid and militant groups filed urgent petitions before the Israeli high court to obtain the dismissal.
The movement for the quality government in Israel, an eminent surveillance group, cited the conflict of interest on the Netanyahu corruption trial and declared that the dismissal actually transformed the role of the attorney general into “political appointment”.
In response, the court rendered an injunction suspended the decision, specifying that the government could not exceed Baharav-Miara of its authority or appoint a replacement until a more in-depth examination, with a hearing before the court which should take place within 30 days.
Immediately after the court’s decision, the Minister of Israeli Communications of the Hard Line, Shlomo Karhi, promised by X not to obey the order of the court, declaring it “invalid”.
“A replacement for her must be appointed immediately!” He said. “We obey the law!” We say to the High Court – No! “
Degeneration of tensions
Baharav-Miara has been rubbed with the government since its entry into office, the growing tensions on the legal reform package of the government division, which was revealed for the first time in 2023, causing major street demonstrations.
In March, the Israeli cabinet had adopted a vote without confidence against Baharav-Miara. The Netanyahu office accused the legal leader of “inappropriate behavior”, claiming that its “substantial differences in current opinion” with the government have prevented “effective collaboration”.
The Attorney General had refuted the allegations and declared that the voting non-confidence aimed to acquire “unlimited power, within the framework of a wider decision to weaken the judicial branch” and “promote loyalty to the government”.
A few days later, the Israeli Parliament adopted a key element of the plans, which criticisms qualified as “judicial coup”, effectively giving politicians more power over the appointments of judges, including judges of the Supreme Court.
Baharav-Miara had also challenged the legality of Netanyahu’s attempt to fire Ronen Bar, the head of the Shin Bet security agency, that the Supreme Court declared “illegal”.
Bar, who left his role at the end of his mandate in June, had carried out an investigation into alleged ties between relatives of the Prime Minister and Qatar, a matter known in the Israeli press under the name of “Qatargate”.
Former Shin Bet chief also refused to sign a security request to relieve Netanyahu to testify during his trial in the course of corruption in which he faces accusations of corruption, fraud and violation of public confidence.
