Washington – The Trump administration urged the Supreme Court on Thursday to allow it to assert the ban on transgender soldiers in the army.
The general solicitor D. John Sauer filed an emergency request to the court to block a national injunction issued by a state judge of Washington.
The challengers say that, among other things, the ban violates the 14th amendment of the Constitution, which requires people to be treated also under the law.
Sauer wrote in the court depositing that the judge’s injunction “cannot be square with the substantial deference that the professional military judgments of the ministry are due”.
The ban is an extended version of a policy that Trump implemented during his first mandate, that the Supreme Court allowed To enter into force. President Joe Biden made these restrictions back When he was in power.
The policy “generally disqualifies military people who suffer from gender dysphoria or who have undergone medical interventions for gender dysphoria,” wrote Sauer.
US district judge Benjamin Settle judged on March 27 that “government’s arguments are not convincing, and this is not a particularly close question.” He noted that the government had not provided updated evidence on the reasons why the new policy was necessary.
The 9th Circuit Court of Appeals, based in San Francisco, refused to block the decision of Settle.
The administration is based on a pentagon decision taken during the first Trump administration which, according to people with gender dysphoria, threatens “military efficiency and lethality”.
A separate case is underway in the District of Columbia, the administration aimed at overthrowing a similar injunction. A court of appeal heard the oral arguments in this case on Wednesday.
The Supreme Court asked the challengers to submit an answer to the administration by May 1. In the meantime, the ban remains blocked.
