The US government has laid its file against Diddy today – and then, exactly two hours later, its defense team too.
In total, federal prosecutors called 34 witnesses over six weeks, presenting jurors of graphic evidence of what they allege was a ruthless criminal enterprise orchestrated by the hip-hop magnate.
Diddy’s lawyers have chosen not to call a single witness, although they have submitted evidence and stipulations in the defense of their client. The rapper’s team also did what is called a request in order 29 to reject the case, arguing that proof of prosecutors was not sufficient to assume a conviction. American district judge Arun Subramanian did not immediately decided on this request.
We are now entering what is probably the final phase of this trial. The jurors will have a break tomorrow while the judge and the lawyers will meet to chop the instructions for the panel of 12 people. Lawyers are expected to present fence arguments from Thursday.

In a notable exchange towards the end of the day, Subramanian asked Diddy how he felt. “I’m fine. Thank you, your honor,” replied the rapper. He added: “You are doing a great job.”
Subramanian then tried to confirm that Diddy would not take the position in his own defense: “Is it your decision not to testify?” Diddy replied: “This is my decision. This is totally my decision. My decision; I make it.”

Today, the Diddy’s team has made its request for acknowledgment of judgment after the government’s affair, and the judge said he would decide on the request. It is a formality: the motion will surely be refused. Defense knows that it will probably be refused.
But the rules require that, in order to preserve the arguments, the defense must move for a judgment of acquittal of rule 29 after the postponement of the accusation.
I can count on a finger the number of requests in rule 29 that I saw granted before the federal court. Indeed, federal prosecutors generally do not accidentally forget to demonstrate a crime or its elements. No one on each side expects this request to be granted. It is more for the preservation of the call file. However, judges often deny these motions right away, but that has not yet happened. Could this mean that the movement has a chance? Most likely not.
Diddy’s defense team confirmed before the court that she would not call witnesses and would only have introduced exhibitions.
I was asked if the defense team did not call any witness because it was confident. I was also asked if the defense did not call any witness because it thinks that the case is hopeless. I would say that the answer is “neither.”
You do not reach the level of these extremely successful defense lawyers by having a negative attitude. But at the same time, defense lawyers are never as Pollyannaaish as customers, who almost always think that the accusation has nothing about them and the cases are dogs.
The choice of not calling witnesses is the safest and most opposite strategy to risks. Whether Diddy’s lawyers feel optimistic or pessimistic, they are clearly one thing: practical.
